A Federal High Court in Abuja on Friday, October 17, 2025, dismissed preliminary objections filed by the Central Bank of Nigeria (CBN) and the Accountant-General of the Federation (AGF) aimed at halting a suit challenging the withholding of local government funds belonging to Osun State.
The case, instituted by the Osun State Government through Attorney-General Oluwole Jimi-Bada, contests the release of statutory allocations to local government officials elected under former Governor Adegboyega Oyetola’s administration, who were later removed from office.
Justice Emeka Nwite, delivering the ruling, dismissed the objections as lacking merit and ordered that the substantive case be transferred to the Federal High Court in Osogbo for further hearing.
The CBN and AGF had argued that Osun State lacked legal standing to file the suit and claimed the matter was already before the Supreme Court in a similar case filed by the Federal Government against the 36 states.

The judge, however, ruled that the issues in the Osun suit are separate and that the state has sufficient interest to pursue the case.
The date for the substantive hearing in Osogbo will be communicated to the parties in due course.
