Emirship Tussle: Court issues perpetual restraining order against Ado-Bayero, four others

The Kano State High Court, presided over by Justice Amina Aliyu, has issued a perpetual restraining order against Aminu Ado-Bayero and four other deposed emirs from Bichi, Rano, Gaya, and Karaye, preventing them from parading themselves as emirs.

The judgment, delivered on Monday, specifically restrains the 15th Emir of Kano, Aminu Ado-Bayero, and the four dethroned emirs, along with their servants, privies, and any other persons appointed by them, from parading themselves as emirs of Kano, Bichi, Gaya, Rano, and Karaye.

This ruling follows a suit filed by the Kano State Government seeking to prevent these individuals from assuming their former titles.

The government had also given the deposed emirs 48 hours to vacate their respective palaces following their deposition.

While delivering the judgment, Justice Aliyu clarified that the issue of evicting Emir Bayero from his Nassarawa mini palace is a matter for a rent tribunal and was not within the purview of the current court case.

Justice Aliyu directed the deposed emirs to hand over all traditional royal artefacts to the government and the substantive Emir of Kano, Muhammadu Sanusi II.

She affirmed that the Kano State Assembly’s Emirate Council Repeal Law 2024 was enacted in accordance with Section 4 of the Constitution.

Additionally, she upheld that the assent given by the State Governor, Abba Yusuf, to the law was constitutionally valid.

This ruling underscores the authority of the Kano State Government in regulating traditional leadership and ensures that the legal framework governing such matters is upheld.

The deposed emirs are expected to comply promptly with the court’s directives.
