The recall of a lawmaker in Nigeria is a constitutional process that allows constituents to remove an elected representative from office before the end of their tenure. Governed by Section 69 of the 1999 Constitution (as amended) and the Independent National Electoral Commission (INEC) guidelines, the recall process is rigorous and involves multiple stages.
Step-by-Step Process of Recalling a Lawmaker in Nigeria
1. Petition by Constituents
The process begins when more than half of the registered voters in the affected constituency sign a recall petition.
The petition must clearly state the reasons for the recall, such as misconduct, incompetence, or loss of confidence.
It is then submitted to INEC’s headquarters for verification.
2. Verification of Signatures
INEC conducts a public verification exercise to confirm that the petition is signed by at least 50%+1 of registered voters in the constituency.
If the required number of valid signatures is confirmed, the process moves to the next stage.
If not, the recall is terminated.

3. Referendum (Recall Election)
If the signatures are verified, INEC organizes a referendum (recall election) within 90 days of receiving the petition.
Registered voters in the constituency will vote “Yes” or “No” on whether the lawmaker should be recalled.
For the recall to succeed, at least two-thirds of registered voters must vote in favour of removal.
4. Official Declaration of Results
If the recall referendum is successful, INEC will certify the outcome and officially declare the seat vacant.
The lawmaker is then removed from office, and a fresh election is conducted to fill the vacant seat.
If the recall fails, the lawmaker retains their position.
Has Any Nigerian Lawmaker Ever Been Recalled?
Despite several attempts, no lawmaker has ever been successfully recalled in Nigeria’s history due to the strict requirements and political interference.
The recall process remains a powerful but rarely successful tool for holding lawmakers accountable.
