Court Rejects NDLEA Bid To Seal Proxy Club

The Federal High Court in Lagos on Wednesday, January 14, 2026, dismissed an application by the National Drug Law Enforcement Agency (NDLEA) seeking to halt the reopening of Proxy Night Club in Victoria Island.

Justice Ambrose Lewis‑Allagoa delivered the ruling after hearing arguments from both sides.

The NDLEA had requested a stay of execution on a December 5, 2025, order directing the club’s unsealing while it pursued an appeal.

NDLEA lawyers argued that allowing the club to reopen could render its appeal meaningless, citing ongoing criminal charges including conspiracy, possession of narcotics, and permitting the premises to be used for drug activities.

The nightclub’s legal team, led by Senior Advocate Chikaosolu Ojukwu, countered that the NDLEA’s application was procedurally flawed and lacked merit.

They emphasized that the agency must prove any offences at trial and that keeping the club sealed unfairly disrupts lawful business and jeopardizes the livelihoods of staff.

Justice Lewis‑Allagoa ruled in favour of the nightclub, stating that the NDLEA had failed to show “special or exceptional circumstances” warranting a stay.

He affirmed the order for the club’s unsealing and directed the NDLEA Chairman to comply promptly with court directives.

The case stems from a midnight raid on October 26, 2025, when NDLEA agents seized 384.662 kg of nitrous oxide and 200 g of cannabis at Proxy Night Club.

Owner Mike Nwalie Nwogu, popularly known as Pretty Mike, and over 100 guests were arrested but later granted bail.

Following the raid, the court refused to grant interim forfeiture of the club and ordered it unsealed within 72 hours, paving the way for its reopening.

The matter is scheduled for further hearing on February 9 and 10, 2026.
