House of Representatives members on Wednesday resolved to appeal the court ruling which directed the Attorney General of the Federation (AGF) to delete Section 84 (12) of the newly signed Electoral Act.
The resolution came as the lawmakers deliberated on the court order during its plenary in Abuja.
They maintained that the clause was directed at political appointees and not civil servants, adding that the court passed a judgment on a matter which was not included in the Electoral Act passed by the National Assembly.
Further wondering why the National Assembly was not joined as a respondent to the suit, the lawmakers described the action of the judge as an ‘aberration’.
The Speaker of the House, Femi Gbajabiamila, said he would not allow the National Assembly to be ridiculed, hence, the lawmakers said they would petition the Abia court judge that gave the order to the National Judicial Council (NJC).
Querying why the judgement was obtained in faraway Abia State, Gbajabiamila and the rest of the lawmakers insisted that only the National Assembly has the constitutional authority to alter any part of the legislation which it passed.
The Speaker, therefore, appealed to the AGF not to hastily implement the court judgement, and not to get into the legitimate functions of the National Assembly.
