US Supreme Court Backs FDA’s Ban on Flavored E-Cigarettes

The United States Supreme Court delivered a unanimous ruling on Wednesday, affirming the Food and Drug Administration’s (FDA) authority to prohibit e-cigarette companies from marketing fruit- and dessert-flavored vaping products.

The 9-0 decision, encompassing both the court’s six conservative and three liberal justices, reinforced the FDA’s stance that such flavors pose a significant risk of addiction among young users.

Health experts have long warned that sweet flavors in vaping devices can attract minors, increasing nicotine dependency among adolescents.

Electronic cigarettes operate by heating a nicotine-infused liquid to produce an inhalable vapor. Unlike traditional cigarettes, they do not contain harmful tar or carbon monoxide.

However, organizations such as the World Health Organization (WHO) and anti-smoking advocates argue that e-cigarettes should not be considered a safer alternative to conventional smoking.

The Supreme Court’s decision overturned an earlier ruling by a conservative judge who had criticized the FDA for allegedly shifting its approval criteria without due process.

That ruling had briefly offered hope to e-cigarette manufacturers seeking to introduce new flavored products to the market.

Despite regulatory efforts, a variety of flavored e-cigarette liquids remain available in the United States, fueling what health officials describe as a nationwide vaping crisis.

Just last month, New York Attorney General Letitia James filed a lawsuit against 13 companies involved in the manufacturing, distribution, and retail of vape devices.

She accused them of deliberately targeting young consumers with addictive products, exacerbating what she described as a growing public health emergency.

The ruling marks a significant victory for federal regulators and public health advocates who have long campaigned for stricter controls on vaping products.
