Appeal Court Strikes Out Kanu’s Rights-Breach Case Against DSS, AGF

The Court of Appeal in Abuja has dismissed Nnamdi Kanu’s appeal challenging alleged violations of his fundamental rights while in the custody of the Department of State Services (DSS).

The IPOB leader had sought relief from the court over claims of mistreatment during his detention.

A three-member panel ruled on Friday, November 28, that the case was “without merit” and effectively moot, following Kanu’s conviction for terrorism offences by a Federal High Court on November 20.

Justice Boloukuromo Moses Ugo, delivering the lead judgment, noted that since Kanu was already serving his sentence at the Sokoto correctional facility, the court could no longer grant his request to be moved from DSS custody.

Kanu’s original suit claimed violations of his rights to human dignity, proper medical care, and freedom of religion during detention.

With his conviction and transfer to prison custody, the appellate court determined that the matter no longer had legal relevance.

The dismissal marks another legal setback for Kanu, who has faced a series of prosecutions since his arrest.
